If you are a victim of Domestic or Family Violence, you have many rights as outlined in Indiana IC Code 35-40-5

·        A victim has the right to be treated with fairness, dignity, and respect throughout the criminal justice process.

·        A victim has the right to be informed, upon request, when their abuser is released from custody or has escaped.

·        A victim of a felony or of a crime of domestic or family violence has the right to confer with a representative of the prosecuting attorney’s office after the crime has been charged, before the trial, and before any disposition of a criminal case involving the victim.

·        A victim has the right to have the victim’s safety considered in determining release from custody of a person accused of committing a crime against the victim.

·        A victim has the right to be heard at any proceeding involving sentencing or a post conviction release decision.

·        A victim has the right to make a written or oral statement for use in preparation of the presentence report.

·        A victim has the right to read presentence reports relating to the crime committed against the victim, except those parts of the report containing the source of confidential information, information about another victim, or information determined confidential or privileged by the judge in a proceeding.

·        The victim must be afforded a fair opportunity to respond to the material included in the presentence report.

·        A victim has the right to pursue an order of restitution and other civil remedies against the person convicted of a crime against the victim.

·        A victim has the right to information, upon request, about the disposition of the criminal case involving the victim or the conviction, sentence, and release of a person accused of committing a crime against the victim.

·        A victim has the right to be informed of the victim’s constitutional and statutory rights.

In addition to these rights, you may request a police report for any Domestic or Family Violence occurrence. You may obtain a copy of any report you file at the Boone County Sheriff’s Office, Records Division located at 1905 Indianapolis Avenue, Lebanon, Indiana.

You may also ask questions of any Deputy Sheriff or police officer that responds to assist you. Officers are trained to help victims and offer important information.

You may apply for a Protective Order in cases of Domestic Violence, Stalking, or any Sex Offense. There are NO fees associated with these types of cases. You should not be asked to pay any fees for filing, process, witness, or subpoenas.

Of the person you are filing the order against.

You may obtain an application for Protective Orders at The Clerk of Courts located at the 2^nd floor of the Boone County Courthouse, Lebanon, Indiana.
